Odomap
The short version: Odomap is a free app for recording your rides and looking after your bikes. Never use it while you're riding: its speed, lean, and other numbers are estimates, not safety tools. Your rides and photos stay yours. Keep your account secure and don't misuse the service, which is provided as it is, without guarantees. If you got Odomap from the App Store, Apple's standard app license applies too.
Please read these Terms carefully. They are a legal agreement, and the summary above doesn't replace them.
These Terms of Use (“Terms”) are an agreement between you and the independent developer who makes Odomap (“we” and “us”). They cover the Odomap app, your Odomap account, and the online services the app uses, such as cloud saving and route planning (together, the “Service”).
By ticking the box to agree when you create an account, or by using the Service, you accept these Terms and our Privacy Policy. If you don't agree, don't use Odomap.
You must be at least 13 years old to create an account. If you're under the age of majority where you live, you may use Odomap only with the permission of a parent or guardian, who agrees to these Terms on your behalf. You may not use Odomap where the law doesn't allow you to.
You need a free account to use Odomap. When you sign up, give accurate information and keep it up to date. Each account is for one person: don't share yours, and don't create one for someone else without their permission.
You're responsible for keeping your password secret and for everything done with your account. If you think someone else has used it, change your password right away and contact us.
Riding a motorcycle is dangerous. Odomap records and reviews your rides; it is not a safety device and doesn't make riding safer.
You alone are responsible for how you ride, for the condition of your bike and gear, and for obeying traffic laws.
Odomap can find places and suggest scenic or faster routes using Google Maps Platform or Apple Maps. Routes are suggestions only. They may be out of date, may include closed, unpaved, private, or unsuitable roads, and don't account for traffic, weather, or road conditions. Always follow road signs, traffic laws, and your own judgment.
Google. Where Odomap uses Google Maps features, you agree to be bound by the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.
Apple. Where Odomap uses Apple Maps, that content is provided by Apple and subject to the Apple Maps terms.
Turn-by-turn directions open in the Google Maps or Apple Maps app, which Google and Apple provide under their own terms. We aren't responsible for those apps or their directions.
“Your content” means the bikes, rides, routes, maintenance records, fuel logs, expenses, notes, photos, documents, and profile details you add to Odomap. You keep ownership of all of it.
You give us a limited, non-exclusive, royalty-free permission to store, copy, process, and transfer your content only as needed to run the Service for you, for example to save it to your account and restore it on a new phone. This permission ends when you delete the content or your account, apart from the short-lived copies described in our Privacy Policy. We never sell your content or use it for advertising.
You're responsible for your content. Only add material you have the right to use, and nothing illegal.
When you use Odomap, you agree not to:
Odomap is currently free. We work to keep it running well, but we can't promise it will always be available or error-free, or that your data will never be lost. Keep your own copies of anything important, such as receipts you need for a warranty or taxes.
Some features have usage limits, such as how much photo storage each account can use and how many Google-powered searches and routes the app makes each month, after which it switches to Apple Maps. We may add, change, limit, or remove features, and we may stop offering the Service. If we decide to stop cloud saving, we'll try to tell you in the app before it ends.
Our Privacy Policy explains what we collect, how we use it, where it's stored, and how to delete it. It forms part of these Terms.
You can stop using Odomap at any time. To delete your account and the data saved to it, go to Settings → Delete Account.
We may suspend or close your account, with notice where reasonable, if you seriously or repeatedly break these Terms, if the law requires it, or if your use puts us, other people, or the Service at risk. Any part of these Terms that by its nature should continue after your account ends, such as sections 11 to 17, will continue.
Odomap, its name and logo, the app, its design, and its software belong to us or our licensors and are protected by law. These Terms don't give you any right to use them except to use the app as these Terms allow. If you send us feedback or ideas, we may use them freely, without any obligation to you.
Odomap is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't promise that the Service will be uninterrupted, secure, or error-free, that its measurements, maps, or routes will be accurate, or that your data will never be lost.
Some places don't allow some of these disclaimers, so they may not all apply to you.
To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or relating to Odomap or these Terms, even if we were told such damages were possible. We aren't responsible for how you ride or for decisions you make based on the app's measurements, maps, or routes.
To the fullest extent the law allows, our total liability for all claims relating to Odomap is limited to the greater of what you paid us for Odomap in the 12 months before the claim and US $50.
Nothing in these Terms excludes or limits any liability that can't be excluded or limited by law.
To the extent the law allows, if someone brings a claim against us because you broke these Terms or the law while using Odomap, you agree to cover the reasonable costs and losses that result.
If you downloaded Odomap from Apple's App Store, these terms also apply:
Apple's standard license. Your license to use the app is also governed by Apple's Licensed Application End User License Agreement (the “Standard EULA”). These Terms add to it. If they conflict about your license to use the app itself, the Standard EULA controls.
Agreement with us, not Apple. These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for Odomap and its content.
Maintenance and support. We alone are responsible for providing any maintenance and support for Odomap. Apple has no obligation to provide any maintenance or support for it.
Warranty. If Odomap fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, that you paid for it. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Odomap.
Claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to Odomap or your possession or use of it, including product liability claims, claims that it fails to meet any legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar laws.
Intellectual property. If a third party claims that Odomap or your possession or use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling, and discharging that claim.
Legal compliance. You confirm that you aren't located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you aren't listed on any U.S. Government list of prohibited or restricted parties.
Third-party terms. When using Odomap, you must follow any applicable third-party terms, such as your mobile carrier's.
Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right, and will be deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
We may update these Terms as Odomap changes or as the law requires. When we do, we'll change the date at the top of this page, and if a change is significant, we'll tell you in the app or by email before it takes effect. If you keep using Odomap after a change takes effect, you accept the updated Terms. If you don't agree with them, stop using Odomap and delete your account.
These Terms, together with our Privacy Policy and, where it applies, Apple's Standard EULA, are the entire agreement between you and us about Odomap. If any part of these Terms can't be enforced, the rest stays in effect. If we don't enforce part of these Terms right away, we haven't given up our right to do so later. You may not transfer your rights or obligations under these Terms to anyone else. We may transfer ours as part of a sale or reorganization of Odomap, as long as your rights under these Terms aren't reduced.
Nothing in these Terms takes away rights you have as a consumer that can't be changed by agreement.
